1. About these terms

1.1 These Terms of Service (the "Terms") govern your use of the website at nixana.com (the "Website"), including the consultation booking tool. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1.2 The Website is operated by Nixana, headquartered in Dubai, United Arab Emirates ("Nixana", "we", "us" or "our").

1.3 These Terms cover the Website only. Any services we provide are governed by a separate written agreement, such as a statement of work or master services agreement, signed by you and the relevant Nixana entity. If there is a conflict, that agreement takes precedence.

2. Use of the Website

2.1 The Website and its content are provided for general information about Nixana and its services. Nothing on the Website is legal, financial, tax, technical or other professional advice, and you should not rely on it as such.

2.2 You may use the Website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Website.

2.3 We may change, suspend or withdraw any part of the Website at any time without notice.

3. Booking a consultation

3.1 You can use the booking tool to request a consultation with Nixana. Consultations are free, carry no obligation on either side, and do not create a client relationship. A client relationship begins only when both parties sign a written agreement.

3.2 When booking, you agree to give accurate contact details and to book only on your own behalf or with authority from your organisation.

3.3 You can cancel or reschedule using the link in your confirmation email. We may also cancel, reschedule or decline a booking, for example where we cannot help or where the booking appears to be spam.

3.4 Please do not share confidential or sensitive information during a consultation unless a confidentiality agreement is in place. Information you share in a consultation is handled under our Privacy Policy.

4. Intellectual property

4.1 All content on the Website, including text, graphics, logos, images, videos and software, is owned by or licensed to Nixana and is protected by intellectual property laws.

4.2 "Nixana" and the Nixana logo are trade marks of Nixana. You may not use them without our prior written permission.

4.3 You may view and print pages for your own internal business reference. You may not otherwise copy, reproduce, distribute, modify or create derivative works from Website content without our prior written permission.

5. Prohibited conduct

5.1 You must not:

• use the Website to send spam or unsolicited communications, or submit false bookings;
• introduce viruses or other malicious code, or attempt to gain unauthorised access to the Website, its server or any connected system;
• use scrapers, bots or other automated tools to extract Website content, including for training artificial intelligence models, without our express written consent; or
• misrepresent your identity or affiliation, or use the Website in any fraudulent or harmful way.

6. Information about our services and results

6.1 Descriptions of our services, timelines, delivery approach and potential cost savings are general and illustrative. Actual scope, timing, outcomes and pricing depend on each engagement and are confirmed only in a signed agreement.

6.2 References to past clients, awards, partnerships or experience describe the background of Nixana and its founders and are not a guarantee of future results.

7. Third-party links and services

7.1 The Website may link to third-party websites, such as LinkedIn, and uses third-party tools, such as our booking and calendar providers. We do not control and are not responsible for third-party content, availability or privacy practices.

8. Disclaimer

8.1 The Website is provided "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, that the Website will be accurate, complete, uninterrupted, secure or free of errors or viruses.

9. Limitation of liability

9.1 To the maximum extent permitted by law, Nixana will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or business opportunity, arising from your use of, or inability to use, the Website.

9.2 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

10.1 Our Privacy Policy, available at nixana.com/privacy-policy, explains how we collect and use personal information through the Website. By using the Website, you acknowledge that policy.

11. Governing law and disputes

11.1 These Terms and any dispute arising from them are governed by the laws of the Emirate of Dubai and, where applicable, the federal laws of the United Arab Emirates. The courts of Dubai have non-exclusive jurisdiction.

11.2 If you are a consumer, you may also have the benefit of mandatory protections under the law of the country where you live, and nothing in these Terms affects those rights.

12. General

12.1 If any part of these Terms is found to be invalid or unenforceable, the rest will remain in effect.

12.2 If we do not enforce any part of these Terms, that does not waive our right to do so later.
